Terms and Conditions

The following Terms & Conditions are also provided during checkout and must be acknowledged before a reservation can be completed. We’ve included them here so you can review everything in advance and know exactly what to expect before booking with Party Totes.

Party Totes Rental Terms & Conditions

By completing a reservation and checking the box indicating acceptance of these Terms & Conditions, the renter agrees to the following:

1. Rental Agreement
The individual completing the reservation must be at least 18 years old and is responsible for the rental equipment and for all persons who use or interact with the equipment during the rental period.

2. Payment & Security Authorization
Full payment is due at online checkout.

A refundable security authorization equal to the rental total is also required at online checkout. The authorization is released after all rental equipment is returned on time, complete, clean, and undamaged.

If any item is lost, missing, damaged beyond normal wear and tear, or returned excessively dirty, the actual reasonable cost of repair, replacement, or additional cleaning may be deducted from the security authorization.

Reasonable cleaning fees may be assessed when equipment is returned in a condition requiring more than normal post-rental cleaning or sanitation. Cleaning fees will generally start at $10 and may increase depending on the amount of additional cleaning required.

The security authorization does not limit the renter’s financial responsibility for cleaning fees, loss, damage, repair, or replacement costs that exceed the authorized amount.

3. Rental Period & Returns
Rental equipment must be picked up and returned during the dates and times listed on the reservation.

Additional consecutive rental days may be booked in advance, subject to availability, at the applicable multi-day rental rate.

Equipment returned after the scheduled return time without prior approval will be charged 100% of the standard one-day rental rate for each additional 24-hour period or portion thereof.

The renter may also be responsible for reasonable losses or expenses caused by a late return, including amounts Party Totes must refund or credit to another customer because the equipment was unavailable as scheduled.

Equipment that is not returned may be considered lost, and the renter may be charged the actual reasonable replacement cost.

4. Equipment Condition
The renter should inspect rental equipment upon pickup and promptly notify Party Totes of any missing, damaged, or malfunctioning items.

Unless otherwise reported, equipment will be considered received complete and in good working condition.

5. Proper Use & Care
Rental equipment must:

  • Be used only for its intended purpose.
  • Be used according to Party Totes instructions and manufacturer guidelines.
  • Be properly supervised when required.
  • Be protected from theft, misuse, weather, water, excessive dirt, and other avoidable damage.
  • Not be modified, altered, subleased, transferred, or loaned to another person or event.

The renter is responsible for the equipment from the time of pickup until it is returned to and accepted by Party Totes.

6. Missing or Damaged Items
The renter is responsible for all equipment and accessories included with the rental, including but not limited to cords, remotes, adapters, microphones, pumps, stakes, balls, game pieces, safety equipment, and other components.

Missing or damaged items may be charged at the actual reasonable cost of repair or replacement.

Normal wear and tear will not be charged.

7. Cleaning Requirements
Rental equipment must be returned reasonably clean and free from food, beverages, mud, debris, excessive dirt, bodily fluids, smoke residue, glitter, confetti, or other excessive mess.

Food- and beverage-contact items must be emptied and washed before return.

Electrical components must never be submerged in water.

Party Totes performs final inspection and sanitation between rentals.

Reasonable cleaning fees may be charged when equipment is returned excessively dirty or requires additional cleaning beyond normal post-rental sanitation. Cleaning fees will generally start at $10 and may increase depending on the amount of additional cleaning required.

8. Adult Supervision & Children
Children must be appropriately supervised by a responsible adult while using Party Totes equipment.

The renter is responsible for determining whether equipment and activities are appropriate for each participant based on age, size, ability, physical condition, and any manufacturer restrictions.

The renter is responsible for communicating applicable safety rules to all participants.

9. Active Games & Recreational Equipment
Activities including Nerf games, laser tag, physical games, inflatable games, water games, and similar recreational activities involve risks including falls, collisions, impacts, slipping, tripping, and other injuries.

Provided safety equipment should be used as directed.

The renter is responsible for providing a suitable play area and supervising participants.

10. Water & Pool Equipment
Pool, beach, splash, and water-related equipment requires active adult supervision.

Party Totes does not provide lifeguard services.

The renter assumes responsibility for safe use around pools, beaches, lakes, wet surfaces, and other bodies of water.

11. Inflatable Equipment
Inflatable equipment must be properly secured using provided stakes, tie-downs, weights, or other anchoring equipment when required.

Inflatables must not be used during unsafe weather, including strong winds, thunderstorms, or other conditions inconsistent with manufacturer instructions.

Blowers and electrical equipment must be kept dry.

12. Outdoor & Weather Conditions
The renter is responsible for monitoring weather conditions throughout the rental period.

Outdoor equipment must not be used during unsafe winds, rain, storms, lightning, or other conditions that could reasonably create a safety risk or damage equipment.

If unsafe conditions develop, use of the equipment must stop immediately.

13. Electrical Equipment
Projectors, speakers, blowers, warming equipment, lighting, karaoke equipment, extension cords, adapters, and other electrical equipment must be kept dry and used only according to their intended purpose and electrical rating.

The renter is responsible for using appropriate outlets and safe electrical connections.

14. Propane Heaters
Propane heaters are for outdoor use only.

They may not be used inside homes, garages, tents, enclosed porches, vehicles, or substantially enclosed spaces.

Propane cylinders must remain upright and properly secured.

Heaters must be operated according to manufacturer instructions and kept appropriate distances from children, combustible materials, structures, decorations, furniture, and other objects.

The renter assumes responsibility for safe propane handling and heater operation.

15. Movie Night Equipment
Projectors, screens, speakers, adapters, cables, and related electronics must be protected from rain, moisture, extreme weather, and physical damage.

Unless specifically included in the rental, the customer is responsible for providing any personal device, internet connection, streaming service, account, or media necessary to view content.

Party Totes does not guarantee compatibility with every personal device or streaming platform.

16. Food & Beverage Equipment
Party Totes provides rental equipment only and does not prepare, handle, serve, or supervise food or beverages.

The renter is responsible for food safety, proper food temperatures, allergens, alcohol service, and safe handling during the event.

17. Assumption of Risk
The renter acknowledges that use, setup, transportation, possession, and operation of rental equipment may involve inherent and foreseeable risks, including but not limited to falls, collisions, burns, cuts, electrical injury, water-related injury, equipment failure, property damage, and other personal injuries.

The renter voluntarily assumes these risks for themselves and for persons they permit to use the equipment.

18. Release & Hold Harmless
To the fullest extent permitted by Illinois law, the renter releases and agrees to hold harmless Party Totes, Massive Vision Brands LLC, and their owners, employees, representatives, and agents from claims, demands, damages, losses, liabilities, or expenses arising from the possession, transportation, setup, use, misuse, supervision, or operation of rental equipment, including claims arising from ordinary negligence to the extent such liability may legally be released.

This release does not apply to liability that cannot legally be waived, including willful or wanton misconduct or other liability that Illinois law prohibits from being waived.

19. Indemnification
To the fullest extent permitted by law, the renter agrees to indemnify and hold harmless Party Totes, Massive Vision Brands LLC, and their owners, employees, representatives, and agents against third-party claims, damages, liabilities, and reasonable expenses resulting from the renter’s or their guests’ use, misuse, supervision, setup, transportation, or operation of rental equipment.

20. Cancellation & Rescheduling

  • Cancellations 7 or more days before pickup: full refund.
  • Cancellations 3–6 days before pickup: full Party Totes credit for a future rental.
  • Cancellations within 72 hours of pickup: 50% refund or full Party Totes credit.
  • No-shows or cancellations after the scheduled pickup time: nonrefundable.
  • If weather makes an outdoor rental unsafe, Party Totes will work with the customer to reschedule the rental or issue a rental credit, subject to availability.

21. Unsafe or Improper Use
Party Totes reserves the right to refuse to release equipment or require the discontinuation or return of equipment if Party Totes reasonably believes it is being used illegally, improperly, or under unsafe conditions.

22. Personal Property
Party Totes is not responsible for personal belongings left inside totes, coolers, equipment containers, or rental equipment after return.

23. Entire Agreement & Severability
These Terms & Conditions, together with the customer’s reservation, constitute the rental agreement.

If any provision is found unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law.

24. Governing Law
